You must not:
- Use the website for any unlawful, fraudulent or unauthorised purpose;

4. Website Information and Accuracy
We aim to ensure that the information provided on the BLOOM website is accurate, current and useful. However, website content is provided for general information purposes and may be updated, changed or removed from time to time without notice.
While we take reasonable care in preparing and maintaining the website, BLOOM does not guarantee that all information will always be complete, accurate, current or free from errors or omissions.
Information published on the website should not be relied upon as a substitute for a specific quotation, professional advice, contractual agreement or other documentation issued by BLOOM in relation to a particular service or transaction.
Where there is a conflict between information on this website and the terms of a specific written agreement or contract with a client, the applicable contractual documentation will take precedence.
5. Request for a Quote
The Request A Quote form on the BLOOM website is provided to allow prospective clients to submit enquiries regarding our services.
Submitting an enquiry through the website does not constitute a binding offer, acceptance or contract between you and BLOOM.
You are responsible for ensuring that the information submitted through the Request A Quote form is accurate, complete and up to date. BLOOM may contact you to request additional information or clarification before preparing a quotation or proposal.
Any quotation, proposal or pricing information provided by BLOOM will be subject to the terms, conditions, validity period and other requirements stated in the relevant quotation or accompanying documentation.
A contract for services will only arise when the applicable contractual requirements have been satisfied and the relevant quotation, purchase order, service agreement or other contractual documentation has been accepted or executed as applicable.
BLOOM reserves the right to decline an enquiry or to determine whether it is able to provide the requested services.
6. Client Responsibilities
Clients and prospective clients are responsible for providing BLOOM with accurate, complete and timely information relevant to any enquiry, quotation or service.
This may include information relating to cargo, goods, quantities, dimensions, weights, values, origin, destination, required delivery dates, customs requirements, permits, documentation and any other information reasonably required to provide the requested services.
You are responsible for ensuring that any information, documents or instructions provided to BLOOM are lawful, accurate and not misleading.
You must promptly inform BLOOM of any material changes to information or instructions previously provided.
Where applicable, you are responsible for obtaining and maintaining any licences, permits, approvals, authorisations or other documentation that are required to be provided by you in connection with the relevant goods or services, unless otherwise agreed in writing with BLOOM.
BLOOM may rely on information and instructions provided by you when preparing quotations or arranging services.
7. Quotations, Pricing and Contracts
Any quotation or proposal issued by BLOOM will be based on the information available to us at the time it is prepared and will be subject to the terms, conditions and validity period stated in the relevant quotation or proposal.
Unless expressly stated otherwise, quotations may be subject to changes in freight rates, fuel costs, exchange rates, customs duties, taxes, port charges, carrier charges, storage charges, demurrage, detention, regulatory requirements and other costs outside BLOOM’s reasonable control.
Any additional work, services, costs or changes to the scope of work requested by a client may be subject to additional charges and may require written approval.
A quotation does not constitute an unconditional commitment by BLOOM to provide services until the relevant contractual requirements have been satisfied.
The terms governing a specific transaction or service will be those set out in the applicable quotation, purchase order, service agreement, terms of business or other contractual documentation accepted by the parties.
8. Third-Party Service Providers
BLOOM may engage or coordinate with third-party service providers where reasonably required to provide or facilitate services for a client.
These may include, without limitation, carriers, shipping lines, airlines, freight agents, customs agents, port operators, terminal operators, transport companies, warehouse operators, suppliers, subcontractors and other logistics or service providers.
Where third-party services are used, those services may be subject to the third party’s own terms, conditions, tariffs, limitations and requirements.
BLOOM will take reasonable care when selecting and coordinating third-party service providers. However, unless otherwise agreed in writing or required by applicable law, BLOOM is not responsible for the independent acts, omissions, delays, failures or performance of third parties outside BLOOM’s reasonable control.
Where appropriate, BLOOM may pass on applicable third-party charges, requirements or conditions to the client.
9. Delays and Events Beyond Our Reasonable Control
BLOOM will use reasonable efforts to provide services in accordance with agreed requirements and timelines. However, delays or disruption may occur due to circumstances beyond our reasonable control.
Such circumstances may include, without limitation, adverse weather, natural disasters, fire, accidents, war, civil unrest, strikes, industrial action, port congestion, customs delays, government action, changes in laws or regulations, border restrictions, transport disruption, carrier delays, equipment failure, shortages, supplier failures, cyber incidents or other events beyond BLOOM’s reasonable control.
Where such circumstances occur, BLOOM will use reasonable efforts to minimise the impact and, where appropriate, keep the affected client informed.
BLOOM will not be responsible for delays, losses or additional costs arising solely from circumstances beyond our reasonable control, subject to any rights or obligations that cannot lawfully be excluded or limited.
10. Intellectual Property
Unless otherwise stated, the content of this website, including the BLOOM name, logo, branding, text, graphics, photographs, designs, layouts and other materials, is owned by or licensed to BLOOM Clearing and Forwarding.
You may view and use the website for your own legitimate personal or business purposes.

Nothing in these Terms & Conditions grants you any ownership or other intellectual property rights in the BLOOM name, logo, branding, website content or other materials.
11. Links to Other Websites
The BLOOM website may contain links to websites or online resources operated by third parties.
These links are provided for convenience and informational purposes only. BLOOM does not control or operate third-party websites and does not necessarily endorse their content, products, services or policies.
BLOOM is not responsible for the availability, accuracy, security, privacy practices or content of third-party websites.
If you choose to access a third-party website through a link on the BLOOM website, you do so at your own discretion and subject to the terms and policies applicable to that website.
12. Liability
Nothing in these Terms & Conditions excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
Subject to the foregoing, BLOOM will not be liable for loss, damage, delay, cost or expense arising from circumstances that are outside BLOOM’s reasonable control or from the acts or omissions of third parties, except to the extent that such liability arises from BLOOM’s own breach of an applicable contractual obligation, negligence or other liability that cannot lawfully be excluded.
BLOOM will not be responsible for indirect or consequential loss, loss of anticipated savings, loss of business opportunity, loss of profit or loss of goodwill, except where such liability cannot lawfully be excluded.
Where a specific service or transaction is governed by a separate contract, quotation, terms of business or other contractual documentation, the liability provisions contained in that documentation will apply to that service or transaction.
Nothing in these Terms & Conditions affects any rights or protections that cannot lawfully be excluded or restricted.
13. Privacy and Personal Information
BLOOM may collect and process personal information when you use the website, submit an enquiry, request a quotation or otherwise communicate with us.
Our processing of personal information is explained in our Privacy Policy, which forms part of the information governing your use of the BLOOM website.
